These Terms of Use (“Terms”) govern your access to and use of the MyFitnessCal mobile application, website, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be legally bound by these Terms.
If you do not agree, you must not use the Service.

1. Eligibility & Capacity

You must be at least 13 years old to use the Service.

By using MyFitnessCal, you represent and warrant that:

• You meet the minimum age requirement

• You have the legal capacity to enter into a binding agreement

• You are using the Service for personal, non-commercial purposes unless explicitly authorized

We reserve the right to suspend or terminate access if eligibility requirements are violated.

2. Nature of the Service (Critical Disclaimer)

MyFitnessCal is a general fitness and wellness tracking platform.

The Service:

• Provides informational and assistive insights only

• Does not provide medical advice, diagnosis, treatment, or prevention of disease

• Is not a medical device and should not be relied upon as such

AI-generated insights:

• Are automated

• May be inaccurate, incomplete, or unsuitable

• Are not reviewed by medical professionals

You acknowledge and agree that:

• Any reliance on the Service is at your own risk

• You are solely responsible for your health decisions

• You should consult qualified professionals before making health-related decisions

3. Account Registration & Security

Certain features require account creation.

You agree to:

• Provide accurate and current information

• Maintain the confidentiality of your credentials

• Accept responsibility for all activity under your account

We are not responsible for losses resulting from unauthorized access caused by your failure to secure your credentials.

4. User Content & Responsibility

You retain ownership of content you submit (“User Content”).

You represent and warrant that:

• You have all necessary rights to submit such content

• Your content does not violate any laws or third-party rights

• Your content is accurate to the best of your knowledge

You grant MyFitnessCal a limited, non-exclusive, royalty-free, worldwide license to store, process, analyze, and display User Content solely to operate, maintain, and improve the Service.

We are not responsible for the accuracy, legality, or consequences of User Content.

5. AI Systems & No Reliance

The Service uses automated systems and artificial intelligence.

You expressly acknowledge that:

• AI outputs are probabilistic and not deterministic

• AI outputs do not constitute advice, instructions, or guarantees

• AI outputs should not be relied upon for decisions affecting health, safety, or wellbeing

MyFitnessCal disclaims all liability arising from reliance on AI-generated outputs.

6. Subscriptions, Billing & Payments

Some features require paid subscriptions or in-app purchases.

• Payments are processed exclusively through Apple App Store or Google Play

• Billing terms, renewals, cancellations, and refunds are governed by the applicable app store

• We do not control payment processing systems

Billing disputes must be resolved through the app store provider.

7. Acceptable Use & Restrictions

You agree not to:

• Misuse or interfere with the Service

• Attempt unauthorized access

• Reverse engineer, copy, or exploit the Service

• Use the Service for unlawful, harmful, or abusive purposes

• Use the Service in violation of applicable laws or regulations

We may suspend or terminate access for violations without notice.

8. Privacy & Data Processing

Your use of the Service is governed by our Privacy Policy, which is incorporated by reference.

By using the Service, you consent to data collection and processing as described therein.

9. Service Availability & Modifications

The Service is provided “as is” and “as available.”

We may:

• Modify, suspend, or discontinue any part of the Service

• Add or remove features

• Perform maintenance or security updates

We are not liable for interruptions, feature changes, or data loss.

10. Termination

You may stop using the Service at any time.

We may suspend or terminate access:

• For violations of these Terms

• To comply with legal obligations

• To protect the integrity or security of the Service

Termination does not affect accrued rights or surviving provisions.

11. Disclaimer of Warranties

To the fullest extent permitted by law:

• The Service is provided without warranties of any kind

• All express and implied warranties are disclaimed

• We do not guarantee accuracy, reliability, or availability

12. Limitation of Liability

To the maximum extent permitted by law:

MyFitnessCal shall not be liable for:

• Indirect, incidental, special, or consequential damages

• Health-related outcomes or physical harm

• Loss of data, profits, or goodwill

• Reliance on AI-generated content

Our total aggregate liability shall not exceed the amount paid by you in the preceding 12 months, or USD $100, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold harmless MyFitnessCal from claims arising out of:

• Your use or misuse of the Service

• Your User Content

• Your violation of these Terms or applicable law

14. Arbitration & Class Action Waiver

Where permitted by law:

• Disputes shall be resolved through binding arbitration

• Claims must be brought individually

• You waive the right to participate in class or representative actions

This clause applies to the fullest extent permitted by law.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

16. Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control, including natural disasters, war, government actions, cloud outages, or internet failures.

17. Export Control & Sanctions

You represent that you are not subject to sanctions or export restrictions and will not use the Service in violation of applicable export control laws.

18. No Fiduciary or Special Relationship

Nothing in these Terms creates a fiduciary, medical, advisory, or professional relationship between you and MyFitnessCal.

19. Compliance With Laws

You agree to use the Service in compliance with all applicable laws and regulations.
We are not responsible for unlawful use by users.

20. Feedback License

If you provide suggestions or feedback, you grant MyFitnessCal a perpetual, irrevocable, royalty-free license to use such feedback without restriction or compensation.

21. Assignment

You may not assign these Terms without consent.
MyFitnessCal may assign these Terms in connection with a merger, acquisition, or asset transfer.

22. Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

23. Survival

Sections relating to disclaimers, limitation of liability, indemnification, arbitration, governing law, and licenses shall survive termination.

24. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and MyFitnessCal.

25. Headings

Headings are for convenience only and do not affect interpretation.
